1. General Statement
By purchasing any digital product on DiagsoCar.com, operated by DiagsoCar, you accept and agree to be bound by the following return and refund policy. This policy governs all sales and interactions regarding downloadable software, licenses, activation codes, and related digital files.
2. No Returns or Refunds After Download
Due to the nature of digital content and software, no returns, cancellations, or refunds are offered once the product has been downloaded or accessed by the customer.
This policy is in full compliance with Polish consumer law, including:
Art. 38 pkt 13 Ustawy o prawach konsumenta (Dz.U. 2014 poz. 827)
Prawo do odstąpienia od umowy zawartej na odległość nie przysługuje konsumentowi w odniesieniu do umów o dostarczanie treści cyfrowych, które nie są zapisane na nośniku materialnym, jeżeli spełnianie świadczenia rozpoczęło się za wyraźną zgodą konsumenta i po poinformowaniu go o utracie prawa do odstąpienia od umowy.
In other words, once you have started downloading or accessing the product, you lose the right to withdraw from the contract.
3. Your Responsibility Before Purchase
Before completing a purchase, you are responsible for:
Carefully reviewing the product description, compatibility requirements, and included features.
Ensuring that the software is suitable for your hardware, vehicle model, or diagnostic equipment.
Understanding that all products sold are digital downloads only, not physical goods.
Confirming the legitimacy and ownership of the PayPal or credit/debit card account used.
Misunderstandings, mistaken purchases, or a lack of technical knowledge do not qualify as grounds for a refund or return.
4. Technical Issues and Support
If you encounter a genuine technical problem (e.g., corrupted file, incorrect archive), please contact our support team at diagsupport@diagsocar.com. We are committed to resolving legitimate issues related to file delivery or integrity.
However, we do not provide installation support or system configuration assistance unless explicitly stated on the product page.
5. Unauthorized Use and Fraud
We monitor all downloads and purchase activity. Attempts to obtain refunds via chargebacks, unauthorized PayPal disputes, or similar actions without first contacting us will be considered a breach of agreement and may lead to:
Termination of access to all purchased content.
Blacklisting of the associated user account and email address.
Legal action in accordance with Kodeks Cywilny and Kodeks Karny, particularly in cases of fraud or deception.
6. Waiver of Right to Withdraw
By confirming your purchase and starting the download process, you are expressly:
Giving informed consent to the immediate execution of the digital delivery.
Acknowledging the loss of your statutory right to withdraw (in accordance with Article 38 of the Ustawa o prawach konsumenta).
Agreeing that the transaction is final and non-refundable once access to the files has begun.
